What is Explicit IP?
Explict Intellectual Property is IP that has been
- written down (codified); and either
- claimed (at least started a legal process to grant ownership of it to the claimant), or
- published defensively
Explicit IP includes
- Patent (in various forms)
- Registered Design
- Trademark
- Copyright
Only Copyright is effectively international, by a treaty known as the Berne Convention.
All the other forms protect the IP only in the jurisdiction where it is registered.
